Welcome to MelodyCast™. These Terms of Use (“Terms”) govern your access to and use of the MelodyCast website, MelodyCast mobile application, MelodyCast products, and related services and features (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
1. About MelodyCast
MelodyCast offers interactive products designed to connect physical keepsakes and décor with digital experiences. MelodyCast products may allow users to access music, photos, videos, links, messages, and other digital content by tapping a compatible device to a MelodyCast-enabled product.
Certain MelodyCast products may include preloaded content and may also be personalized through the MelodyCast App.
2. Eligibility and Acceptable Use
You may use the Services only in compliance with applicable laws and these Terms.
You agree not to misuse the Services, interfere with their normal operation, attempt to gain unauthorized access to any system or account, circumvent security or usage restrictions, introduce malicious software, or use the Services for unlawful, fraudulent, abusive, or harmful purposes.
You are responsible for activity performed through your account or device and for maintaining the security of any account credentials associated with the Services.
3. MelodyCast Products and Compatibility
Certain MelodyCast products use tap-enabled technology that requires a compatible smartphone or other compatible device.
Device compatibility, operating systems, browser behavior, third-party software, and other technology outside of MelodyCast's control may affect functionality. We do not guarantee compatibility with every device, operating system, browser, or future software version.
Physical modification of a MelodyCast product may also affect its functionality. Materials or accessories that interfere with the product's tap-enabled technology, including certain metals, magnets, or electronic components, may prevent or reduce successful scanning.
4. Preloaded Content
Some MelodyCast products are provided with preloaded digital content that can be accessed without using the MelodyCast App.
Preloaded content may include music, videos, webpages, or other digital experiences. Availability of third-party or externally hosted content may change over time for reasons outside of MelodyCast's control.
Unless otherwise stated, purchasing a MelodyCast product does not transfer ownership of any copyrighted music, video, artwork, or other third-party content associated with the product.
5. MelodyCast App and Personalization
The MelodyCast App may allow you to personalize a MelodyCast product with content such as photos, videos, music, playlists, links, URLs, messages, or other digital material.
Personalization is optional unless otherwise stated. Certain MelodyCast products may be used with their included content without downloading the MelodyCast App.
Features and functionality of the App may change, be improved, added, removed, or discontinued over time.
6. Your Content
You retain ownership of photos, videos, messages, links, and other content that you submit, upload, select, or otherwise provide through the Services (“User Content”).
By providing User Content through the Services, you grant MelodyCast a limited, non-exclusive license to host, store, process, transmit, reproduce, and otherwise use that content only as reasonably necessary to operate, maintain, improve, and provide the Services to you.
This license does not transfer ownership of your User Content to MelodyCast.
You are responsible for your User Content and represent that you have the rights and permissions necessary to use and provide that content through the Services.
7. Copyrighted Music and Third-Party Content
The ability to associate a MelodyCast product with a song, playlist, video, webpage, or other third-party content does not give you ownership of that content or permission to infringe another person's intellectual-property rights.
You are responsible for ensuring that your use of music, photographs, videos, artwork, and other copyrighted material complies with applicable law and the terms of the service from which that content originates.
MelodyCast does not grant licenses to music, videos, or other third-party content except where expressly stated.
8. Third-Party Services and Links
The Services may interact with or link to third-party websites, applications, platforms, or services, including music, video, social-media, and content-hosting services.
Those services are controlled by their respective providers and may be subject to separate terms and privacy policies.
MelodyCast does not control and cannot guarantee the continued availability, functionality, accuracy, or content of third-party services. If a third-party provider changes or discontinues a service, link, API, webpage, playlist, video, or other content, the corresponding MelodyCast experience may also be affected.
9. MelodyCast Originals
The MelodyCast App may offer curated content identified as MelodyCast Originals or similar content made available for use with MelodyCast products.
Unless otherwise stated within the App, MelodyCast Originals may be used through the MelodyCast Services for personal, non-commercial use. Making content available as a MelodyCast Original does not transfer ownership of that content to the user.
The selection and availability of MelodyCast Originals may change over time.
10. Purchases
Products purchased through MelodyCast.net are subject to the prices, shipping terms, availability, and other information displayed at the time of purchase.
Prices and product availability may change without notice. We reserve the right to correct pricing, product-description, inventory, or other errors and to cancel or refund an order when reasonably necessary because of such an error.
Applicable taxes, shipping charges, and other fees will be displayed where required during checkout.
11. Shipping and Returns
Shipping estimates are estimates and are not guaranteed delivery dates. Delays may occur because of carriers, weather, holidays, supply conditions, or other circumstances outside our reasonable control.
Returns, refunds, and other purchase-related matters are governed by the policies posted on MelodyCast.net at the time of purchase.
12. Premium Features and Paid Services
MelodyCast may offer optional paid, Premium, subscription-based, or other enhanced features in the future.
If paid features are offered, applicable pricing, billing frequency, renewal terms, included features, and cancellation information will be presented before purchase.
Purchases made through an app marketplace may also be subject to the payment, subscription, refund, and cancellation policies of that marketplace.
13. Intellectual Property
The MelodyCast name, logo, branding, product designs, website and app interfaces, graphics, text, software, and other MelodyCast-created materials are owned by or licensed to MelodyCast and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or create derivative works from MelodyCast intellectual property without authorization.
Nothing in these Terms transfers ownership of MelodyCast intellectual property to you.
14. Privacy
Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.
Depending on where you live, you may also have additional privacy rights. Information about applicable opt-out rights is available through the Your Privacy Choices page on MelodyCast.net.
15. Service Availability
We work to keep the MelodyCast Services available and functioning properly, but digital services occasionally experience interruptions.
We do not guarantee that the website, App, personalization features, preloaded content, third-party links, or other digital functionality will always be available, uninterrupted, error-free, or compatible with every device.
We may perform maintenance, update features, or modify the Services as reasonably necessary.
16. Disclaimer of Warranties
To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Except for warranties that cannot legally be excluded, MelodyCast disclaims implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits any warranty or consumer right that cannot legally be waived or excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, MelodyCast and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services.
This includes, where permitted by law, losses resulting from unavailable third-party content, inaccessible links, device incompatibility, service interruptions, or loss of User Content.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
18. Suspension or Termination
We may restrict or terminate access to some or all of the Services if we reasonably believe that a user has violated these Terms, misused the Services, infringed another person's rights, engaged in fraudulent or unlawful activity, or created a security risk.
You may stop using the Services at any time.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes to MelodyCast products, the App, our business practices, or applicable law.
When these Terms are updated, the revised version will be posted on MelodyCast.net with an updated “Last Updated” date.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
